(General) terms and conditions
Article 1 Applicability
These conditions apply to all offers, order confirmations and agreements where SCT Tickets acts as the seller of tickets. The Dutch text of these terms and conditions is binding and rights cannot be derived from any translation. Additions to or deviations from these terms and conditions shall only apply if explicitly accepted by SCT Tickets. No rights can be derived from any promises made by any SCT Ticket employee unless they have been explicity confirmed by SCT Tickets. Terms and conditions from buyers/customers shall not apply unless their applicability is explicitly accepted by SCT Tickets.
Article 2 Definitions
In these conditions apply:
SCT Tickets: the name of the company (for further details art. 10).
Ticket: the admission ticket for an event.
Buyer: the person with SCT Tickets concludes an agreement to provide tickets (admission tickets) for events such as concerts, sporting events etc.
Order confirmation: an electronic confirmation by SCT Tickets of the order placed by the buyer which is sent to the email address provided by the purchaser or given to him by SCT Tickets.
Delivery costs- and service fees: These are made up of several components, namely administrative costs, if necessary, packaging costs, transaction costs and costs incurred when the product is sent by email (this because we can not automatically perform this transmission).
Article 3 Placement of orders, prices and payment
An order by the buyer shall be deemed to have been placed by the buyer if: (I) said buyer has specified in the SCT Tickets booking procedure which ticket(s) said buyer wishes to receive, (II) said buyer has filled in the other information required, and (III) this booking has been received by SCT Ticket after it has been sent. An order by the buyer shall also be deemed to exist if said buyer has passed on all the required information through te phone to SCT Tickets. An order shall be final once SCT Tickets has acknowledged receipt of the order by sending an order/booking information. Payment is made at one of the methods specified by SCT Tickets (s). Prices are expressed in Euros and all costs are included, including VAT.
Article 4 Price
Reselling is involved in relation to the sale of tickets by SCT Tickets. SCT Tickets prices will be different from the prices that may be specified on the tickets themselves and the buyer cannot derive any rights from these prices. The price charged by us is higher than the face value of the tickets and all costs are included excluding shipment costs. Please call in or email us for the face value of the tickets. The price is unique for each order. The price may vary with every order. Prices are expressed in Euro’s.
Article 5: Payment
Payment must take place using one of the methods specified on the SCT Tickets website or, as a departure from this, using a method to be further specified by SCT Tickets. All payments will be taken in Euro’s.
Article 6: Delivery of tickets
SCT Tickets aims at ensuring buyers receive tickets at least two to five (2-5) days prior to the event. Shipment and issue shall be at the expense of the buyer. Tickets shall be sent by e-mail or by normal mail. The buyer will be written informed of sending the tickets by SCT Tickets.
The tickets shall be deliverd at the address as specified by the buyer, unless nobody is available to receive them. Should this be the case, shipping agent will leave written notification that shall list the telephone numer of the nearest distribution office, where the shipment will be retained for a certain time. SCT Tickets shall not be held liable should delivery of the tickets fail due to provision of an incorrect address by the buyer. Should this be the case, please also note that tickets are not insured. Should the buyer not accpet, pick up or have picked up a ticket sent to said buyer, and the ticket is returned to SCT Tickets, said buyer shall be obliged to compensate SCT Tickets for the costs incurred in relation to the return shipment. Costs and risks for non-visiting the event because of the reasons mentioned above, are for the buyer. SCT Tickets may deliver the tickets up to the moment the event starts, for example until the kick-off in football matches. In some cases the tickets are delivered to your hotel. It is the responsibility of the buyer to provide SCT Tickets with the correct delivery address. At any time the buyer is obliged to inform SCT Tickets of any change in address.
Article 7 Special provisions and liability
SCT Tickets is not liable for (consequential) damage, including (consequential) damages if the delivery of the tickets fail as a result of specifying an incorrect address, incomplete informing the occupant of the address, or if the purchaser doesn’t take delivery of the tickets, and the buyer in advance of the shipment notified or if the hands of third parties engaged by SCT Tickets are late or not delivered. For such a situation, the tickets are not guaranteed.
In some cases, especially in sporting events, tickets may display a name that does not match the name of the buyer of the ticket. The buyer of a ticket supplied by SCT Tickets must behave as a good and orderly visitor of events and must follow instructions given by or due to the organiser of an event to be visited by said buyer as well as by the competent authorities.
SCT Tickets shall not be held liable should organisers of an event or the authorities deny the buyer of a ticket delivered by SCT Tickets admission to an event due to an international act or omission or gross negligence of said buyer.
The buyer of a ticket shall visit an event at his or her own risk. SCT Tickets shall not be held liable for damages that the buyer may suffer while travelling from or to the event or attending such an event.
The quality categories specified by SCT Tickets for tickets shall not harmonise with any categories used by the organiser of the event for which the tickets have been issued. The buyer cannot derive any right from the category class and/or ranking. SCT Tickets retains the right to upgrade tickets without incurring further costs or obligations on its part.
The buyer of a ticket supplied by SCT Tickets must obtain information himself or herself in relation to instructions given by or on behalf of the organiser of the event or the authorities as well as changes with regard to the event such as starting times and similar. SCT Tickets shall not have obligation to further inform the buyer of the ticket ragarding this.
Please not that it is the responsibility of the buyer to be informed about the correct dates and starting times of events. Football matches, especially, may be postponed or moved one day earlier, in very short notice to the match, due to television rights. SCT Tickets cannot influence this. It is therefore at own risk by moving games, and there is no refund.
SCT Tickets prices are subject to fluctuations related to the demand for and the availability of tickets. The buyer cannot derive any rights from increases of reductions of prices once said buyer has placed an order. The price confirmed to the buyer at the time of ordering will therefore remain the effective price.
Lost, stolen or damaged tickets cannot be duplicated.
If you want to cancel is basically impossible. However, we will treat seriously any cancellation request. In some cases we can return your tickets, however take. We will look at each situation the amount we can give back. You always pay 20% fee.
Article 8 Guarantees
If the order is completed, the tickets are guaranteed and the agreement is not fulfilled due to circumstance not attributable to said buyer , SCT Tickets will refund the full amount of the order, unless failure is not attributable to SCT Tickets (for example, when applies for suspension or bankruptcy of the organizer).
If the buyer is denied admission to the event due to a circumstance not attributable to said buyer, SCT Tickets will refund the full amount of the order.
In case of failure of SCT Tickets to deliver the full quantity of tickets contracted for according to these terms and conditions, SCT Tickets will refund the full amount of the order, including shipment costs, provided the buyer contacts SCT Tickets within (5) five days after the tickets should have been delivered.
In the event of cancellations of an event, SCT Tickets will offer substitue tickets on the basis of availability or refund the full amount of the order including shipment costs, provided the buyer contacts SCT Tickts within (5) five days after the announcement of the cancellation of the event.
Guarantee leaves intact the remaining rights to which the buyer is entitled.
Article 9 Other provisions
SCT Tickets points out that the sale of tickets by the organizer of the event general sale conditions can be explained which the organizer prohibits the selling of these tickets. As a consequence, the organizer can cancel tickets and refuse access to the event. In that case, 100% of the agreed price including shipping will be reimbursed.
Article 10 Data SCT Tickets
SCT Tickets.nl's office is at (5103 CB) Dongen, Kamilletuin 4. SCT Tickets was registered under number 70528004 at the Chamber of Commerce in Breda (Netherlands). SCT Tickets can be reached via email@example.com and +31 6 40 21 52 58. SCT Tickets is a commercial company specializing in offering tickets for sold out or popular events and also for so-called hard-to-get tickets. SCT Tickets is not associated to any official point of sale or organizer.
Article 11 Applicable law
The agreement is subject to Dutch law. Insofar as deviation from the statutory jurisdiction are allowed, the competent court in the district Breda takes knowledge of any disputes that may arise between SCT Tickets and the buyer.
